a) General Information

Accessing our site and using the online booking system implies knowledge and acceptance of the Terms and Conditions of Use. BONASERV srl. the owner of the site www.elbons.com (.ro, .eu) and the ELBONS mark reserves the right to make changes to these Terms and Conditions, The user having in this regard the obligation to review the Terms and Conditions. If you do not agree with the changes made, please stop accessing and use it. BONASERV srl. reserves the right to block access to Users who infringe these Terms and Conditions of Use or any other relevant provisions of applicable law.

b) General definitions of terms

The term „ Site ” refers to the elbons.com website (.ro, .eu) The design and content of the site belongs to BONASERV srl. and are protected by copyright and related rights law, as well as other intellectual property rights.
The term „ User ” refers to any natural or legal person who accesses the elbons.com website (.ro, .eu) and who, after accepting the terms and conditions of this site, makes an « online booking ».
The term „ importer ” refers to BONASERV srl., Headquartered in Hărman 507085 – str. Stefan cel Mare 327M / b1 and P.L. str. Oltului nr.40, jud. Brașov, registered at the Trade Register under no. J08 / 1855/2004, having CUI RO1665450.

c) Terms of Use

c1) Purpose of the service we offer

Through the site, BONASERV srl. by ELBONS provides individuals with an online platform through which the User can book ELBONS electric vehicles manufactured and available in its stock. The prices displayed on this site do not apply to cars that will be manufactured on the basis of an order placed with an ELBONS agent or similar vehicles existing in the stock of ELBONS agents.
Booking is not a vehicle purchase operation.
Booking confirmation does not have the legal effect of concluding a sale-purchase contract online. The conclusion of the contract for sale-purchase of the reserved vehicle is subsequently made, in the offline environment, between persons present, at the ELBONS headquarters, by signing the order form and handing over to the user the price payment notice (advance / difference).
The vehicles in the images on the site are for presentation and some of them are equipped with optional equipment/equipment whose cost is already included in the displayed price. No other car equipment/equipment displayed on this site may be added. All information on endowments and technical data is presented for information purposes, without generating contractual obligations for BONASERV srl – ELBONS . All technical details of the vehicles are available at the ELBONS headquarters .

c1.1) Shopping cart

The shopping cart available on the site is intended to provide the user with a first step towards booking a car. Adding a product to the shopping cart is not his reservation. The car is considered reserved only after paying the reservation fee.

If two or more users add a car to the cart, it will be reserved for the first person to pay the reservation fee. In this case the car will disappear from the other/other users’ basket.

c1.2) list of favorites

The favorites list is a feature that allows the user to be able to save preferences for one or more cars that he can book by paying the related fee at a certain time at time. The list of favorites does not in any way represent the final booking of a car, at any time it can be in several favorite lists for several users.
If the existing car in a user’s favorites list is booked by another user, it will disappear from this list.

c2) Cancellation and changes of the reservation made/refund of the reservation fee

If you wish to reimburse the amount paid as a booking fee for an ELBONS model, please follow the following steps and read the conditions carefully:

1. No advance shall be refunded for electric vehicles which have been ordered at the request of the user with optional modifications (regardless of their nature), thus the full amount paid as a booking fee is constituted as merchant compensation (importer).

1.1. The amount shall not be refunded if there are less than 40 calendar days until delivery.
1.2. 50% of the amount shall be refunded if it is between 41 and 60 calendar days until the date of delivery agreed by the parties.
1.3. 75% of the amount paid as a booking fee is refunded, 25% is constituted operating fees supplier ( importer )

2. If you still want to give up please Fill in and sign the application.

3. Submit by sending by email commercial@elbons.ro the request to BONASERV srl. via ELBONS and you receive the confirmation message on the email address you placed the order.

Reimbursement of the amount will be made by bank transfer within 30 calendar days from the date of submission of the application. The exchange rate applicable for the return of the reservation fee (partial or full according to the conditions of art. c.2 / 1 / 1.1 is at the EUR-RON BNR -2% exchange rate%)
Careful! Once initiated, the reimbursement process is irreversible. The car reserved by you will become available for booking by someone else.

c3) Payment of the reservation fee

The payment authorization will be made with OP to BONASERV srl bank. through ELBONS . The booking fee is 30% (VAT included), payable in lei at the course communicated by BONASERV srl. by ELBONS on the day of its payment at the BNR exchange rate + 2% )
A vehicle is considered reserved when the payment of the reservation fee is confirmed by the banking unit to which the Fact payment was made. BONASERV srl process by ELBONS. In the absence of such confirmation, the vehicle is not considered reserved and may be sold to another user.

The user has 2 calendar days to pay the reservation fee of 30% ( VAT included ) from the moment he requested to book a car on the elbons.com platform . If the user does not pay the booking fee of 30% ( VAT included ) within this period, BONASERV srl. by ELBONS reserves the right to cancel the car reservation and to release it for reservation to another potential buyer.
This Booking Fee originally paid may be considered as part of the price of the vehicle only subject to the conclusion of the sale-purchase contract. The prices shown include VAT. In case of a technical or material error regarding the price of the vehicle, caused by system problems, not attributable to BONASERV srl. by ELBONS, the latter reserves the right to refuse to make the reservation.

c4) Delivery

This site is intended exclusively for online booking of ELBONS vehicles and the sale of accessories and spare parts .
After paying the Booking Fee, the User will receive a registration number by e-mail, and the conclusion of the sale-purchase contract will be made at the ELBONS headquarters.
The user has at his disposal max. 15 calendar days from the lifting notification to pay the difference between the booking fee and the value with which he purchased the electric vehicle from the elbons.com platform.
If the user does not pay the difference between the booking fee and the value with which he purchased the vehicle within this period, BONASERV srl. by ELBONS reserves the right to cancel the car reservation and to release it for the reservation of another potential buyer through the elbons.com platform or otherwise. In this situation, the rule from art. c.2 / 1 / 1.1
Delivery conditions will be found on the order form concluded between persons present and signed at ELBONS headquarters. The reservation of the ELBONS vehicle selected by the user will be valid within the available stock or future entries in the ELBONS warehouse. BONASERV srl. by ELBONS reserves the right to refuse reservations that exceed the stock or its capacities to deliver in optimal conditions the beneficiary’s request.

c5) User Obligations

The user assumes (without being limited to) the following obligations:

Not to use this site for speculative purposes or for the purpose of generating false or non-compliant reservations with the Terms and Conditions of this Site.
To be financially liable for all transactions made during the booking fee.
To provide a correct and valid email address, BONASERV srl. by ELBONS not being responsible for any damages caused as a result of the transmission of an incorrect/invalid e-mail address.
To respect the confidentiality of data and not to provide a third party with the username and password of the e-mail address.
Not to pay the reservation fee on behalf of another individual.
Not to use this site for commercial purposes. BONASERV srl. by ELBONS reserves the right to suspend the possibility for a user to pay the reservation fee for one or more cars if he considers that the site is used for purposes commercial (car resale).

c6) Links to other websites

This site may contain links to other sites that may be operated by other parties involved in this process. The full responsibility for the content and operation of these sites lies with their holders. BONASERV srl. by ELBONS is not liable for any damage or loss caused by the information provided by those sites.

c7) Privacy policy on personal data

Protecting the information you provide is extremely important to us. Here are some things you need to know about the information we collect, the purpose for which we collect it, how we use it and with whom we still share it.   • Send personalized advertising ads about our vehicles, products and services;

  • Conduct customer satisfaction surveys.

What kind of personal data do we collect?

Any information we have about you is most likely provided by your – for example you have filled out a form on this site. You can have access at any time to the data collected about you, respectively:

  • Type of application; Origin of demand;
  • Purchase data (machine model, products and services requested);
  • Navigation data from Bonaserv and Elbons websites

How long will we store your data

As shown below, the maximum periods during which we will store your data. After the expiration of this period, your data will be deleted safely.

  • Managing the pre-contractual relationship with customers – 5 years
  • Sending relevant information about vehicles and services, measuring performance promotion campaigns, sales and after-sales services – 3 years for customers/1 year prospects
  • Sending personalized advertisements about vehicles, products and services, as welland offering personalized experiences to customers – 3 years for customers/1 year prospects
  • Conducting customer satisfaction surveys – 1 year since the survey has end

Collection and processing of anonymous data

This website uses software to analyze the use. By evaluating this data, important information can be obtained about the needs of Users. This information contributes to optimizing the quality of the offer. Thus, the following data are saved indefinitely at each access:

  • The anonymized form of the IP address of the computer from which the access is made;
  • Date and time of access or request;
  • Name of the accessed page / file accessed
  • (website inside or outside) visited before accessing the current page;
  • Browser used by the user, including the browser version;
  • The operating system used by the user.

These information are used for statistical purposes. In this sense, it is exclusively information that does not allow the identification of the person of the User. The user will remain anonymous until an account is created.

Cannot copy, download, reproduce, post etc. no text, image to be used for commercial purposes or distributed without the prior written consent of BONASERV srl. by ELBONS . The use for commercial purposes without the consent of BONASERV srl of any elements of the content of the site will attract liability according to the laws in force.

d) Disclaimer

BONASERV srl. by ELBONS does not assume responsibility for the content of comments posted by users, but reserves the right to delete any content considered inappropriate for the site. BONASERV srl. by ELBONS is not liable for damages created as a result of the non-functioning of the site as well as for those resulting from the impossibility of accessing certain links published on the site. BONASERV srl. by ELBONS reserves the right to prohibit access to the site at any time without prior notice and without being held liable for any direct or indirect damage to Users.

 

d1) Fraud and hacking

Any attempt to access another User’s personal data, modify the content of the site or affect the performance of the servers on which the site runs will be considered a crime, and BONASERV srl. by ELBONS reserves the right to notify the competent legal bodies.

e) Various clauses

If any of the above clauses are found null and void, for whatever reason, it will not affect the validity of the other clauses. The above terms and conditions are governed by Romanian law. In the event of any conflicts, the parties will seek to resolve them amicably. If amicable settlement is not possible, the conflict will be resolved by the competent territorial courts in Brașov.
